How Tax Sales Work in Nova Scotia (and What You Need to Know in Colchester County)

As a real estate agent here in Truro, I get asked now and then about tax sales - what they are, how they work, and whether they’re worth looking into. On the flip side, I also meet homeowners who worry about what happens if they fall behind on their property taxes.

The truth is, tax sales aren’t as complicated as they sound, but they do come with some important things to understand. Here’s a breakdown of how they work in Nova Scotia, and a few tips if you’re thinking of buying or if you’re a homeowner in arrears.


What Is a Tax Sale?

A tax sale happens when a municipality sells a property to recover unpaid property taxes. These sales are governed by Nova Scotia’s Municipal Government Act, and they can involve homes, land, cottages, or even vacant lots.

Municipalities don’t want your property; they just want the taxes paid. But if the bill isn’t cleared after repeated notices, the property can end up on the auction block.


How the Process Works

  1. Taxes Fall Behind

    • Interest starts building the moment property taxes go unpaid.

  2. Lien Registered

    • After an undetermined amount of time, the municipality can place a lien on the property.

  3. Notice Sent

    • Owners and any mortgage holders are formally notified.

  4. Property Advertised

    • The property is listed for tax sale, often in local papers, at municipal offices, and online, such as on Social Media or the Municipalities Website Page.

  5. Public Auction

    • Properties are auctioned off, with the starting bid usually set at the amount of taxes owing plus costs. The winning bidder must put down a deposit right away and pay the balance within a few days.


After the Sale - What's a Redemption Period?

What’s a redemption period? A redemption period is the time after a tax sale where the original owner can still reclaim the property by paying back all the overdue taxes, interest, and costs. If they pay in time, the sale is cancelled, and the buyer gets their money back. This can be anywhere from 6 months to a year, sometimes longer.


The Buyer’s Perspective

Tax sales can offer opportunities, but they aren’t without risk:

Upsides

  • Potential to purchase at a lower cost

  • Access to properties that may never hit the open market

Downsides

  • Properties are sold “as-is, where-is” with no inspections

  • Hidden issues (like environmental concerns) aren’t wiped away

  • Sales can be challenged if proper procedure wasn’t followed


The Owner’s Perspective

If you’ve fallen behind on taxes, you’re not out of options. Paying off the arrears before the auction stops the sale. Some municipalities will even set up a payment plan if you ask. The key is to act early, once the sale happens, it’s too late.
